WEEE Directive 2016 FAQs

The UK Waste Electrical and Electronic Equipment (WEEE) Regulations have been updated for 2016 and now require producers and distributors to finance the collection, treatment and recycling or reuse of this particular waste stream. Am I affected by the regulations?

You have a WEEE obligation if any of the following points apply to you:

  • You re-brand, with your own brand, EEE (Electrical and Electronic Equipment) that was manufactured by another company.

  • You manufacture EEE under your own brand.

  • You import EEE into the UK.

  • You sell EEE to household consumers

I am a manufacturer of EEE, what are my obligations?

You are classed as a ‘producer’ under the WEEE regulations. This means if you place more than 5 tonnes of EEE onto the UK market you must:

  • Join a WEEE compliance scheme within 28 days of placing EEE onto the UK market

  • Complete data submissions detailing the amount of EEE placed onto the UK market

  • Ensure EEE is marked with the crossed out wheeled bin symbol and a producer identification mark e.g. brand name

  • Finance the cost of the collection, treatment, recovery and environmentally sound disposal of WEEE

Producers that place 5 tonnes or less of EEE onto the UK market must:

  • Register directly with the Environment Agency

  • Complete an annual data submission detailing the amount of EEE placed onto the UK market

  • Ensure EEE is marked with the crossed out wheeled bin symbol and a producer identification mark e.g. brand name

I do not manufacture EEE myself but I do import it into the UK, what are my obligations?

When you buy EEE from a country outside of the UK, you are subsequently importing EEE products, meaning that you are then classed as a producer, and therefore have the same obligations as a producer. If you sell to household consumers as well, you will also have additional obligations as a distributor (please see FAQ regarding selling to household consumers below).

I sell EEE to household consumers, but I do not manufacture it, are my obligations any different?

Yes, your obligations differ in that, under the WEEE regulations, you are classed as a ‘distributor’ rather than a ‘producer.’

As a distributor, you must provide the following to your consumers:

  • Offer in-store take back on a like-for-like basis for all types of EEE that you sell. For example, if you sell remanufactured inkjet and/or toner cartridges, you must provide a recycling scheme for your customers, or if this cannot be offered in-store, you must instead provide information – in writing - to your customers about where they can recycle their cartridges.

  • Provide information to household consumers (if requested) about your role in recycling, the environmental impacts of hazardous substances found in WEEE, the importance of separating WEEE from other waste streams and the meaning of the 'crossed out wheeled bin symbol'.

OR

  • Join a Distributor Take back Scheme (DTS) and make a financial contribution which will be used to help set up WEEE collection facilities throughout the UK

I am classed as a Distributor but do not currently offer a ‘take back’ scheme, can you help with this?

We can help you implement a free recycling/take back scheme as we already have an established collection arm (The Recycling Factory). We can supply freepost envelopes that you can distribute with your cartridge orders for your customers to use, or - if you have space within store - freestanding recycling boxes that accommodate larger volumes of inkjet and toner cartridges. We also operate a free UK-wide courier collection service for boxes, and the treatment and recycling of all cartridges takes place under one roof at our UK based facility.

If you are a large producer, some of the schemes may also take on the legal responsibility for your compliance with the WEEE Regulations, and help with the collection, treatment and recycling of waste electrical and electronic equipment.
